Terms of the Brand Exit Feasibility Study
These terms apply when you buy a Brand Exit Feasibility Study ("the study") from Ecoformix Ltd, trading as Formula to Exit (company number NI712157, registered office 48 Bachelors Walk, Lisburn, County Antrim, BT28 1XN). The qualification call is free and is not covered by these terms.
What you are buying
A written business case on one product line, or a small shortlist of lines, from your own range or formulation library. It covers, as far as the information you give us allows:
- The proposed product line and why that one
- Three forecasts: what the category already pays today, a managed Amazon brand, and the full build with off-Amazon traffic and the US
- Estimated profit per unit after Amazon fees, advertising and our fee, at your cost of goods
- An exit estimate for years two to three using published market multiples for online brands
- A trademark search on the proposed brand name and a compliance scan covering labelling, safety data and claims
- Opening production quantities per line
- Ownership and selling account options, and our proposal to build and run the brand
The study is delivered as a written document by email.
Price and payment
The study costs £500 plus VAT at the applicable rate, payable in full before work starts. You will receive a VAT invoice.
Timing
We aim to deliver within seven working days of receiving payment and the information we ask you for at the start. If we need more from you, the clock pauses until we have it.
What we need from you
Product names and categories, pack sizes, your cost price per unit, and how the products sell today. We do not need, and will not ask for, formulations, recipes or manufacturing processes.
Refunds and cancellation
- If you cancel before we start work, we refund the full amount.
- Once work has started, no refund is due, because the value of the study is in the work itself.
- If we conclude that nothing in your range qualifies, you still receive the written verdict and the reasons. That is a full study and no refund is due.
Business customers do not have a statutory cooling-off period. If you are buying as a consumer, which we do not expect, you have the right to cancel within 14 days, but by asking us to start work inside that period you agree that you will pay for the work done up to the point you cancel.
Forecasts are not promises
The forecasts and the exit estimate are our professional opinion based on publicly available sales data, published valuation multiples and the information you give us. They are not a guarantee of sales, profit, a sale of the brand or a sale price. Market conditions, competition and your own decisions all affect the outcome.
No obligation to go further
Buying the study does not commit you or us to building a brand. If we both want to go ahead, that is a separate written agreement on separate terms.
Confidentiality
We keep everything you give us for the study confidential and use it only to produce the study and, if you choose, to discuss the next step. We do not share it with third parties except the service providers named in our privacy notice.
Ownership of the study
Once paid for, the study document is yours to keep and use as you wish. We keep the right to reuse our own methods, templates and general market findings, but nothing that identifies you or your products.
Liability
Our total liability to you in connection with the study is limited to the price you paid for it. Nothing in these terms limits liability for fraud, or for death or personal injury caused by negligence, or anything else that cannot be limited by law. We are not liable for loss of profit, revenue or business opportunity arising from decisions you take on the basis of the study.
Law
These terms are governed by the law of Northern Ireland and the courts of Northern Ireland have exclusive jurisdiction.
